These Terms & Conditions ("Terms", "Terms of Service") govern access to and use of the website www.dermamd.in (the "Platform"). Please read these Terms carefully before using the Platform.
1. Platform Owner & Legal Identity
The Platform is owned and operated by Epidermia Aesthetic Solutions Private Limited, a company incorporated under the Companies Act, 2013, having its registered office at B154, Shravan Building, Tarangan Society, Kusumagraj Marg, Samata Nagar, Thane – 400606, Maharashtra, India ("Company", "We", "Us", "Our").
The Platform operates as an inventory-based e-commerce platform for the sale of cosmetic, personal care, over-the-counter (OTC) and, where permitted in the future, prescription products, in accordance with applicable Indian laws.
2. Applicability of Laws
These Terms are drafted and shall be governed in accordance with:
- The Indian Contract Act, 1872
- The Consumer Protection Act, 2019
- The Information Technology Act, 2000 and rules thereunder
- The Digital Personal Data Protection Act, 2023
- Drugs & Cosmetics Act, 1940 and applicable rules (where relevant)
3. Acceptance of Terms
By accessing, browsing or using the Platform, placing an order, or availing any services, You agree to be legally bound by these Terms, the Privacy Policy, the Disclaimer Policy, and all policies incorporated by reference. If You do not agree, please discontinue use of the Platform.
4. Eligibility to Use the Platform
- You must be competent to contract under the Indian Contract Act, 1872.
- Minors may use the Platform only under the supervision of a parent or legal guardian.
- The Company reserves the right to suspend or terminate access if eligibility conditions are not met.
5. Nature of Products Sold
5.1 Cosmetic & OTC Products
Currently, the Platform primarily sells cosmetic and personal care products intended for external use and general wellness.
5.2 Prescription Products (Future Enablement)
Certain products (e.g., topical minoxidil formulations) may be classified as prescription-only products under Indian law. Sale of such products, if enabled in the future, shall:
- Require upload and verification of a valid prescription
- Be fulfilled strictly under a valid pharmacy licence
- Be subject to additional verification and compliance requirements
The Company does not guarantee availability of prescription products at any time.
6. Pharmacy Fulfilment & Invoicing
Orders placed on the Platform may be fulfilled and invoiced through a licensed retail-cum-wholesale pharmacy operated by the Company. This is a compliance and fulfilment mechanism and shall not be construed as:
- Provision of medical advice
- Creation of a doctor–patient relationship
- Representation that all products sold are drugs or medicines
7. No Medical Advice
- Information provided on the Platform is for general informational purposes only.
- Product descriptions, recommendations, or content do not constitute medical advice, diagnosis, or treatment.
- Users are advised to conduct a patch test before use.
- Users are advised to consult a qualified medical practitioner before using any product where required.
8. Skin Care Expert Assistance (Non-Medical)
The Platform may offer access to trained skin care experts who:
- Are not doctors or dermatologists
- Do not provide medical advice, diagnosis, or prescriptions
- Operate using non-clinical, algorithmic guidance for cosmetic product selection only
Any redirection to dermatology clinics or doctor consultations is informational and requires separate consent on the clinic platform.
9. Account Registration
- Users may browse without registration.
- Account creation is required for purchases and order tracking.
- Users are responsible for maintaining confidentiality of login credentials.
10. Orders & Acceptance
- Orders constitute an offer to purchase.
- Acceptance occurs only upon dispatch confirmation.
- The Company reserves the right to reject or cancel orders at its discretion.
11. Pricing & Payments
- Prices are inclusive/exclusive of taxes as displayed.
- Prices may change without notice.
- Payments may be processed via third-party payment gateways.
12. Cash on Delivery (COD)
COD is offered as a facility, not a right, and may be:
- Restricted by order value, geography, or user history
- Withdrawn or modified at any time
13. Shipping & Delivery
13.1 Shipping Charges & Conditions
Shipping charges, eligibility for free shipping, order value thresholds, delivery options, and any other shipping-related commercial terms shall be as displayed on the Platform at the time of checkout. The checkout page shall be the final and authoritative source for such terms applicable to an order.
13.2 Delivery Timelines
Estimated delivery timelines displayed on the Platform are indicative only. In the absence of a specific delivery date, orders shall be delivered within 14 days from order confirmation, unless delayed due to factors beyond the Company’s reasonable control, including courier partner delays, weather conditions, regional restrictions, force majeure events, or logistical constraints.
13.3 Product Authenticity & Batch Variations
All products sold on the Platform are authentic. Batch numbers, outer packaging, labelling, and other visual elements may vary based on inventory rotation and availability. Such variations shall not be considered a defect and do not impact the quality, safety, or intended use of the product.
13.4 Product Images & Visual Representation
Product images displayed on the Platform are for illustrative and reference purposes only. Certain product images may be digitally created, enhanced, or generated using artificial intelligence (AI) to aid visual representation. Such images are not intended to exactly replicate the physical appearance, texture, size, colour, or packaging of the actual product. Variations in visual appearance do not affect the authenticity, quality, safety, or intended use of the product.
13.5 Reference to Shipping Policy
Detailed terms relating to shipping, cancellations, returns, exchanges, and refunds are governed by the Shipping, Cancellation & Refund Policy, which forms an integral part of these Terms.
14. Cancellations, Returns & Refunds
14.1 Order Cancellation
Before Dispatch
Orders may be cancelled before dispatch by contacting customer support. Once an order is dispatched or marked ready for shipment, cancellation is not guaranteed.
After Dispatch
If an order has already been dispatched, cancellation may be attempted by refusing delivery at the time of delivery. Refunds, if applicable, shall be processed only after the returned shipment is received and verified at the warehouse.
For combo packs or bundled products, partial cancellations are not permitted and cancellation shall apply to the entire order.
14.2 Returns & Exchanges
- Due to the personal and hygienic nature of cosmetic and personal care products, returns are accepted only in cases of verified defects, damage during transit, incorrect delivery, missing items, expired products, or empty/used products delivered.
- Return requests must be raised within two (2) days of delivery.
- An unboxing video clearly showing the sealed package is mandatory for all defective or incorrect delivery claims.
- Products must be returned in original condition with packaging, labels, seals, and barcodes intact.
14.3 Refund Processing
- Refunds are initiated only after returned products are received and pass quality verification.
- Refunds are processed within two (2) to four (4) business days after verification and credited to the original payment method within five (5) to seven (7) business days, subject to banking timelines.
- For Cash on Delivery orders, refunds shall be processed via bank transfer upon receipt of valid bank details.
14.4 Returned-to-Origin (RTO)
If a shipment is returned due to non-delivery, refusal, or incorrect address, refunds shall be processed only after the product is received back at the warehouse and verified.
15. User Conduct
Users agree not to:
- Violate applicable laws
- Misuse the Platform
- Post unlawful, misleading or harmful content
16. Intellectual Property
All Platform content is owned by the Company. No rights are granted except limited personal use.
17. Third-Party Links
The Platform may contain links to third-party websites, including clinic websites. The Company is not responsible for third-party content or policies.
18. Limitation of Liability
To the maximum extent permitted by law:
- The Company shall not be liable for indirect or consequential damages.
- Aggregate liability shall be limited to the lower of the order value or INR 1,000.
19. Indemnity
Users agree to indemnify the Company against losses arising from breach of these Terms or misuse of the Platform.
20. Arbitration & Dispute Resolution
- Disputes shall be resolved by arbitration under the Arbitration and Conciliation Act, 1996.
- Seat and venue: Thane, Maharashtra.
- Single arbitrator.
- Courts at Thane/Mumbai shall have jurisdiction for interim relief.
21. Governing Law & Jurisdiction
These Terms shall be governed by the laws of India. Subject to arbitration, courts at Thane/Mumbai shall have exclusive jurisdiction.

23. Amendments
The Company may modify these Terms at any time. Continued use constitutes acceptance of revised Terms.
