Welcome to www.dermamd.in (the “Platform”). These Terms & Conditions (“Terms”) govern your access to and use of the Platform, including browsing, purchasing products, and booking clinic services.

By accessing or using the Platform, you agree to be bound by these Terms, the Privacy Policy, the Disclaimer Policy, and any other policies notified from time to time.
If you do not agree, please do not use the Platform.

The Platform is owned and operated by Epidermia Aesthetic Solutions Private Limited, a company incorporated under the Companies Act, 2013, having its registered office at:

4. Applicability & Acceptance

These Terms apply to all visitors and users (“Users”, “You”, “Your”) accessing the Platform from any device.

Certain features require account registration. Continued use constitutes acceptance of these Terms.

5. Services Offered

The Platform allows you to:

Browse and purchase cosmetic and cosmeceutical products
Book online consultations (when offered)

All usage is subject to these Terms and applicable policies.

6. Modifications to Platform or Terms

We reserve the right to modify, suspend, or discontinue any part of the Platform or these Terms without prior notice. Continued use signifies acceptance of changes.

7. Intellectual Property

All content on the Platform, including text, images, graphics, videos, logos, software, and design (“Platform Content”), is owned by the Company and protected under applicable intellectual property laws.

You may use Platform Content only for personal, non-commercial purposes. Any reproduction, distribution, or exploitation without prior written permission is prohibited.

8. User-Generated Content

You are solely responsible for any content you submit. By submitting content, you grant the Company a perpetual, irrevocable, worldwide, royalty-free license to use, modify, publish, and distribute such content.

You agree to indemnify the Company against claims arising from your content.

9. Account Registration & Security

You may browse without registration. To place orders or book services, account creation may be required.

You are responsible for:

Providing accurate information
Maintaining confidentiality of login credentials

Any activity under your account is deemed authorized by you.

10. User Obligations

You agree:

To use the Platform only for lawful, personal purposes
Not to resell products
Not to misuse, hack, scrape, or disrupt the Platform
Not to post offensive, defamatory, illegal, or infringing content

Violation may result in suspension or termination.

11. Products & Medical Disclaimer

Packaging may vary across batches
Descriptions and reviews do not constitute medical advice
Users must consult qualified professionals before use

The Company is not liable for individual allergic or adverse reactions. Patch testing is advised.

12. Orders & Availability

Orders are confirmed only upon dispatch notification.
We reserve the right to cancel orders due to pricing errors, stock issues, or payment failure.

13. Pricing & Payments

Prices are exclusive of delivery charges unless stated.
Payments are processed through authorized third-party gateways.

Ownership transfers only upon successful payment.

14.Online Appointment Booking

Appointments are subject to doctor availability.
Rescheduling is permitted once.
Consultation fees are payable before the appointment (during the booking).

15. Delivery

Delivery timelines are indicative and exclude weekends and public holidays.
Delays may occur due to external factors.

16. Cancellations, Returns & Replacements

Orders may be cancelled before dispatch
Products are non-returnable
Replacements allowed only for damaged, defective, expired, or incorrect items
Claims must be raised within 2 days with unboxing proof

17. Third-Party Services

We do not endorse or control third-party services displayed on the Platform and are not liable for their acts or omissions.

18. Confidential Information

All non-public information on the Platform is confidential and may not be disclosed without written consent.

19. Disclaimer of Warranties

The Platform is provided on an “as is” and “as available” basis.
We make no warranties regarding accuracy, uninterrupted access, or fitness for a particular purpose.

20. Limitation of Liability

To the maximum extent permitted by law:

The Company shall not be liable for indirect or consequential damages
Total liability shall not exceed the amount paid by you or INR 1,000, whichever is lower

21. Indemnity

You agree to indemnify and hold harmless the Company from claims arising from your use of the Platform, violation of these Terms, or infringement of rights.

22. Downtime

We are not responsible for temporary unavailability due to maintenance or technical issues.

23. Governing Law & Dispute Resolution

These Terms are governed by Indian law.
Courts at Mumbai shall have jurisdiction.

Disputes shall be resolved through arbitration seated at Thane, Maharashtra, under the Arbitration and Conciliation Act, 1996.
